Website Terms

1 About these terms

These terms govern your use of ap-art.org, operated by The Therapy Room Associates, LLC, located at 185 Devonshire St, Suite 502, Boston, MA 02110, United States ("APART," "we," "us"). APART presents art, design projects, an interactive Studio, a virtual Gallery, and a Game. Please read these terms before using the site. If you do not agree, do not use it.

2 Visiting and using the site

You may browse the site and use its experiences for lawful purposes. Studio and Game are intended for visitors aged 16 or older. If you are below the age of legal adulthood where you live, use them only with a parent or guardian's permission and subject to any applicable provider age requirements.

Do not interfere with the site's operation, attempt unauthorized access, introduce malicious software, bypass security measures, send spam, harass others, or submit material that infringes someone else's rights. Do not use automated tools to extract protected content or overload the site without permission, except where permitted by law.

3 Artwork and other content

Artwork, photographs, videos, text, design, audio, animation, and other site content belong to APART, the credited creators, or their respective licensors. The providers retain rights in their platforms and software.

Viewing the site or completing a game gives you no ownership or rights to reproduce, adapt, distribute, sell, or commercially use its content. Obtain permission unless your use is allowed by law. You may share APART links without suggesting endorsement. Statutory copyright exceptions remain unaffected.

4 Studio and AI responses

Studio includes an AI conversation experience powered by Formless. Responses may be inaccurate, incomplete, or out of date. Treat them as an introduction to APART's work and confirm important details directly with us.

Studio responses are not binding quotations, project acceptance, availability commitments, or professional advice. Using APART creates no client, therapeutic, or advisory relationship. Commissioned work requires a separate agreement.

Please send only information you have the right to share. Do not submit sensitive personal information, payment credentials, or confidential project material through Studio. Contact us first if a project requires a separate confidentiality arrangement.

5 Information you submit

You retain any rights you have in information or material you submit. You authorize us and the providers we use to process it as needed to operate the requested experience and respond to you, subject to the Privacy Policy and applicable law. Sending an inquiry does not give us ownership of your work or permission to publish it as a testimonial.

6 Embedded services and external links

Studio uses Formless by Typeform, Gallery uses KUNSTMATRIX, and Game uses Amuse Labs PuzzleMe. Your use of a provider's service may be subject to its applicable terms. These documents are available through the Formless legal hub, KUNSTMATRIX Terms and Conditions, and Amuse Labs Terms of Service.

Provider functionality, availability, and settings can change. We cannot guarantee that puzzle progress or conversation history will always be saved or restored. External links may lead to independently operated websites with different terms and privacy practices. Nothing in this section removes responsibilities we have under applicable law for services provided through APART.

7 Availability and responsibility

We may update, replace, suspend, or remove site content and experiences. The site is provided on an "as available" basis. To the extent permitted by law, we do not warrant uninterrupted access, error-free operation, or that the site will meet a particular purpose.

To the extent permitted by law, APART is not liable for indirect or consequential losses, including lost profits or business opportunities, arising from use of the site. This does not exclude or limit liability for fraud, deliberate misconduct, gross negligence, death or personal injury caused by negligence, or any liability or consumer right that applicable law does not allow us to exclude or limit.

8 Changes and contact

We may revise these terms and will post the revised version with its updated date. Material changes will receive any notice or agreement required by law and will not retrospectively remove accrued rights. A separate agreement for a project or service governs that project or service if it conflicts with these website terms.

If a provision cannot be enforced, the remaining provisions continue to apply to the extent permitted by law. Nothing here requires you to give up mandatory consumer protections or a right to bring a claim in a court available to you under applicable law.

Privacy Policy

1 Who we are

APART is an art and design website operated by The Therapy Room Associates, LLC, located at 185 Devonshire St, Suite 502, Boston, MA 02110, United States ("APART," "we," "us"). This policy explains how personal information is handled when you visit ap-art.org, use its interactive experiences, or contact us.

We are responsible for the personal information we collect or have processed on our behalf. Some providers also process information for their own purposes, as described in their notices linked below. You can contact us about information submitted through APART, including Studio conversations and game-related information.

2 Information handled when you visit

Messages, conversations, and files. Studio requests your name and email address and may also request a phone number. If file uploads are offered and you choose to use them, we receive the files and information they contain. We also receive your questions, project interests, and conversation content. Studio uses AI to respond. Conversations and summaries are stored in Formless, and conversation information is sent to our support email inbox so we can respond. Within APART, access to these records is limited to the site administrator. Our providers also process these records to deliver their services.

Voice input. If a voice feature is available and you choose to use it, your audio and any resulting transcript may be processed by Formless and its speech-processing providers. Microphone access requires browser permission; opening APART does not itself grant that permission. You can revoke it in your browser settings.

Technical and usage information. Our hosting, content-delivery, and embedded-service providers receive information needed to deliver their services, such as your IP address, browser and device information, request times, and the pages or resources requested. Depending on the service and your browser settings, they may also receive referring-page information, browser identifiers, preferences, and interaction data.

Game information. PuzzleMe processes your puzzle progress, completion status, gameplay interactions, and settings. APART receives a completion signal to display the finished artwork and thank-you screen.

APART does not offer visitor accounts, purchases, or payment functionality. Please do not submit passwords, payment-card details, medical information, or other sensitive or confidential material through Studio, including in uploaded files.

3 Services used on APART

  • Webflow and content delivery. Webflow hosts the website. Images and transition videos are delivered through Webflow asset services and Amazon Web Services infrastructure. These services receive technical requests from your browser. Webflow Privacy Policy.
  • Formless by Typeform — Studio. Formless, provided by Typeform, S.L., supplies the AI conversation experience and processes responses on our behalf. Its published provider lists include OpenAI for AI processing and Amazon Web Services for hosting. Additional providers may support transcription, monitoring, and support. Formless legal hub — select Privacy Policy, Data Processing Agreement, or Cookie Policy.
  • KUNSTMATRIX — Gallery. KUNSTMATRIX Technologies GmbH supplies the virtual exhibition and its media controls. It receives technical and interaction information when its experience loads and uses analytics to measure exhibition visits and interactions. This processing can involve cookies, browser identifiers, device information, and usage events, as described in its privacy notice. If you use an artwork inquiry feature, information you enter may be sent to us and processed by KUNSTMATRIX. KUNSTMATRIX Privacy Policy.
  • Amuse Labs PuzzleMe — Game. Amuse Labs supplies the jigsaw player and uses Google Analytics to measure game usage, interactions with game controls, and technical errors. PuzzleMe also uses cookies, browser storage, and its servers to recognize returning players and save progress and preferences. Persistence depends on service settings and your browser. For the embedded game, Amuse Labs processes gameplay information on our behalf; requests about APART gameplay should therefore come to us. See PuzzleMe data privacy information and the Amuse Labs Privacy Policy.
  • Email services. Our email provider processes messages and copies of Studio conversation information delivered to our support inbox so we can respond to inquiries.
  • Fontshare and UNPKG. The site requests its font from Fontshare and a display script from UNPKG. These requests disclose technical connection information, including your IP address, to the services delivering those resources.

Some embedded experiences load in the background when you open APART, including Studio and Game. Their providers may therefore receive technical information before you select an experience. Returning Home does not necessarily end those connections or delete information already collected. Leaving Gallery stops its playback, but does not erase provider records.

4 Cookies, browser storage, and analytics

Embedded services use cookies or browser storage to support sessions, security, settings, and saved puzzle progress. KUNSTMATRIX and Amuse Labs also use analytics within Gallery and Game. Analytics processing may involve browser identifiers, device information, visit or session information, and interaction events, which the providers may share with their analytics partners, including Google for PuzzleMe. Our transition selection and page navigation operate within the current page session and do not themselves create a persistent visitor profile.

APART has not installed separate analytics scripts or advertising pixels outside its embedded services. We use the contact information and conversation content you provide to respond to your inquiries and related follow-up, not for marketing mailing lists, targeted advertising, or sale to third parties. The analytics described above concern use of the embedded experiences; they are separate from our handling of your inquiries.

You can block or delete cookies and site data using your browser settings and use any privacy controls offered within an embedded service. Blocking storage may prevent an experience from remembering your settings or progress. Deleting local browser data does not necessarily delete records already stored on a provider's servers.

This policy explains data handling; it does not treat continued browsing as consent to optional tracking.

5 How and why information is used

We use personal information to provide the site's experiences, respond to messages and project inquiries, understand how the embedded experiences are used, resolve technical problems, protect the site from misuse, and meet legal obligations or resolve disputes.

Where European or UK data protection law applies, the relevant basis is our legitimate interest in operating a secure website and answering ordinary inquiries; taking steps you request before entering a contract, or performing a contract; complying with a legal obligation; or consent for activities that require it. We consider your rights when relying on legitimate interests. You can withdraw consent without affecting processing that was lawful before withdrawal.

Providing contact details or conversation content is voluntary. Without the relevant information, we may be unable to answer a question or follow up on an inquiry. Studio generates conversational responses; it is not used to make decisions about you with legal or similarly significant effects.

6 Sharing and international processing

Information is made available to the providers needed to host the site, operate its experiences, process conversations, and support communications. We may also disclose information when required by law, to obtain professional advice, or where reasonably necessary to protect rights, safety, or the site from misuse.

Providers may process information outside your country, including in the United States, the European Economic Area, the United Kingdom, Canada, and India. The location depends on the provider and service. Where required by applicable law, we use appropriate transfer safeguards, such as standard contractual clauses. Formless's processing agreement includes these clauses for relevant transfers. Contact us for information about safeguards relevant to your data.

7 Retention and security

Studio uses our Formless account's default retention settings. We have not set automatic deletion for individual conversations, so records may remain until deleted under our service arrangements.

Email copies are retained separately while needed for your inquiry, related projects, or legal recordkeeping. Deleting a Formless conversation does not delete its email copy. You can request deletion from either location, subject to applicable legal exceptions.

Technical logs, saved game state, and provider-held records have separate retention periods under the applicable service arrangements. Reloading the page, leaving an experience, or closing your browser is not a request to delete those records. Deletion may also be subject to limited backup cycles and legal retention requirements.

We use reasonable safeguards appropriate to the information we handle. No online service can guarantee absolute security.

8 Your choices and rights

Depending on the law that applies, you may have rights to access, correct, delete, or obtain a portable copy of your personal information; restrict or object to processing; withdraw consent; and complain to a data protection authority. Applicable US state laws may also provide rights concerning targeted advertising, sale or sharing of personal information, certain profiling, and appeals of request decisions.

To make a request, email info@ap-art.org. Tell us which APART experience you used and approximately when. We may need proportionate information to verify your request and locate the relevant records, and may coordinate with a provider. Do not send passwords or authentication cookies. We will respond within the period required by applicable law and explain any permitted limits on your request. We will not discriminate against you for exercising applicable privacy rights.

9 Children

APART is not directed to children under 13. Studio and Game are intended for visitors aged 16 or older. We do not knowingly collect personal information from children below these applicable ages. If you believe a child has provided information through APART, contact us so we can investigate and arrange appropriate deletion.

10 Changes

We may update this policy as the site or our practices change. The date above identifies the latest version. We will provide additional notice or seek consent when required by applicable law.
